If a landlord provides a contract but never asks the tenant to sign it does this means that the tenant lives there illegally and that this could be reported to the police?

Dear Franzi,
A rental contract exists when both parties have agreed with the main term of the lease regardeless of the formality give to that agreement. So there could be a legal binding rental contract depiste it is not put in written. If both tenant and landlord agree with the lease of the property and both behave accodingly (ie. tenant pays the rent and enjoy the property and landlord accepts the payment of the rent), we can say there is a legal binding contract.
